Haywood's Bully Yard Sales Contract
This contract is made and entered into on this ________day of ____________ to Haywood From Haywood's Bully Yard, here in after referred to as "seller", and ________________, here in after as "buyer". The aforesaid parties mutually agree upon said pup being of _______ registration due to breeding of ___________________ (sire) and ______________________(dam), Due the month of ___________. The buyer is to pay a down payment of $________ for the assurance of said pup leaving a balance of $________ due 7 weeks from aforesaid date of birth, if shipping is required; otherwise 8 weeks from time of birth.
Conditions of Sale
1. Both Buyer and Seller acknowledge that no representations, verbal or implied, have been made with regards to said dogs future abilities (i.e. size, color, fertility, etc.)
2. Seller warrants to the best of his/her ability that said dog is sound and free from disease. Buyer has the option to take the puppy within 48 hours of purchase date, at their own expense, to a veterinarian of their choice. If puppy is found to have a life threatening illness before the age of 12 months of age, seller will replace that pup from the next available litter. An adverse health report must be received in writing and signed by a licensed veterinarian stating that the condition is life threatening and untreatable (excluding skin , coat, and hips). Any treatable condition does not apply.
3. It is to both Seller and Buyer to understand that all breeds are prone to certain health problems. The American Pit bull is prone to hip Dysplasia, the blue pits are more prone to demodex mange, and some even heart problems. As a breeder I am aware of these traits in the breed and try to the best of my knowledge to breed with out these problems, but make it aware to the buyer that this may or may not happen when buying a dog of this breed. I do suggest and will provide a brochure to educate you on health insurance for your dog to keep them at their healthiest.
4. If pup is to be shipped a health certificate will be provided, registration papers will be sent certified by mail, not with pup. Confirmation of delivery will be required. If pup is picked up Buyer will receive registration papers and a complete health certificate at that time. If pup is picked up it must be by buyer on record with photo I.D.
5. The buyer fully understands and agrees that mistreatment or fighting of any kind is punishable by law and at not point will be said pit bull be introduced to such circumstance of any kind by buyer or anyone in relations to buyer. We will confiscate the dog/puppy and take legal actions to the full extent with a fine of $25,000.00.
6. If shipping is required. Shipping charges, including crate, airfare, health certificate, which totals 275.00 dollars, and must be received in full by the time the so called puppy is 7 weeks of age. The fee of 275.00 is a fee for a 8 week old puppy, older puppies or dogs will cost more in shipping fee's for weight and larger crates. Only pups paid in full will be shipped. If all money is not received by the 7th week from the pups date of birth, then all money is forfeited or transferable. No refund will be awarded.
Down Payment
1. Buyer understands by sending in their first payment, this represents a full understanding and agreement to the mentioned conditions. Buyer will be required to sign and return this agreement by certified mail for my records.
2. Under no Circumstances will a down payment be refunded. Down payments can only be transferred to another litter. If chosen litter is of greater value the said buyer agrees to pay the complete difference after payment is applied.
3. If buyer declines puppy for any reason, be advised that the down payment can only be transferred to another litter or forfeited.
4. It is the buyers responsibility to make sure that the seller has complete and accurate information to be able to contact buyer regarding payments and updated on pups. Seller will not attempt to find buyer if unable to locate buyer after reasonable attempts according to seller, at which point buyer's requested pup will be sold and buyer will no receive no reimbursement regarding monies put toward requested pup or dog.
Payments
Seller will only accept the following payments : Credit cards, money orders, certified checks, Pay pal, or western union. NO Personal checks will be accepted.
All Puppies must be paid in full by 8 weeks from the time of birth or 7 weeks if shipping is required.
Seller does suggest that all monies be sent certified requiring signature upon delivery for buyer's assurance as well as seller's.
